It is argued that Adam Smith criticizes David Hume's account of the origin of and continuing adherence to the rule of law for being not sufficiently Humean. Hume explained that adherence to the rule of law originated in the self-interest to restrain self-interest. According to Smith, Hume does not pay enough attention to the passions of resentment and admiration, which have their source in the imagination. Smith's offers a more naturalistic and evolutionary account of the psychological pre-conditions of the establishment (...) and morality of justice than Hume had. Yet, Smith's account also makes room for a thin conception of Lockean natural right to property, while rejecting the contractualist and rationalistic elements in Locke. It emerges that Smith severs the intimate connection that Hobbes and Hume made between justice and property. (shrink)

This paper reviews Aristotle’s problematic relationship with modern economic theory. It argues that in terms of value and income distribution theory, Aristotle should probably be seen as a precursor to neither classical nor neoclassical economic thought. Indeed, there are strong arguments to be made that Aristotle’s views are completely at odds with all modern economic theory, since, among other things, he was not necessarily concerned with flexible market prices, opposed the use of money to acquire more money, and did not (...) think that the unintended consequences of human activity were generally beneficial. The paper argues however, that this interpretation goes too far. The Benthamite neoclassical theory of choice can be seen as a dumbing down of Aristotle’s theory, applicable to animals, not humans. Adam Smith and Karl Marx were deeply influenced by Aristotle’s work and both started their main economic works with Aristotle: Smith ultimately rejecting, and Marx ultimately developing Aristotle’s views of the use of money to acquire more money. Possibilities for the future development of a new Aristotelian Economics are explored. (shrink)

Some hold that musical works are fusions of, or coincide with, their performances. But if performances contain wrong notes, won't works inherit that property? We say ‘no’.

Most studies of No-Excuses charter schools are distributive in nature. They answer a question of distributive justice: do these schools adequately close the academic achievement gap that exists in America between white and Black or Hispanic students? When discussion of No-Excuses schools is limited to their distributive worth, critics of No-Excuses schools are trapped. Are they really against high academic achievement, supporters of No-Excuses schools might say. This analysis seeks to escape this trap by proposing and doing an analysis of (...) No-Excuses schools using relational justice. A turn to relational justice recognizes other educational goods schools might deliver to their students. By focusing on relational justice, the author moves the debate over No-Excuses schools into a register in which both their supporters and their opponents can work toward common aims. The author uses Anthony Laden’s relational justice to analyze No-Excuses discourse and practice and then offers recommendations to both No-Excuses schools and education theorists. (shrink)

This paper examines the characteristics of infectious diseases that raise special medical and social ethical issues, and explores ways of integrating both current bioethical and classical public health ethics concerns. Many of the ethical issues raised by infectious diseases are related to these diseases’ powerful ability to engender fear in individuals and panic in populations. We address the association of some infectious diseases with high morbidity and mortality rates, the sense that infectious diseases are caused by invasion or attack on (...) humans by foreign micro‐organisms, the acute onset and rapid course of many infectious diseases, and, in particular, the communicability of infectious diseases. The individual fear and community panic associated with infectious diseases often leads to rapid, emotionally driven decision making about public health policies needed to protect the community that may be in conflict with current bioethical principles regarding the care of individual patients. The discussion includes recent examples where dialogue between public health practitioners and medical‐ethicists has helped resolve ethical issues that require us to consider the infected patient as both a victim with individual needs and rights and as a potential vector of disease that is of concern to the community. This book traces the translation history of German philosophy, with long and well-justified layovers in Paris, proposing an innovative translation strategy toward addressing the long-standing difficulties in its translation. The volume discusses the context around why German philosophy, whose profundity is often understood to lie in German's iconic polysemous vocabulary, has been so difficult to translate. To best grapple with its complexity, Hawkins outlines a strategy of "differential translation," which involves translating conceptually dense German terms with multiple different terms (...) in the target text, rather than the conventional standard of selecting one term and using it consistently. The book explores how this strategy, which runs counter to the expectation of readers and translators, has played out in debates across both the French-language and English-language translation landscapes, with well-known translators such as Adam Phillips and Joan Stambaugh boldly in favor and others such as Jean Laplanche polemically against it. The book encourages researchers and translators to continue to question norms in translation practice and write translations that do justice to the multifarious meanings in Germanic vocabulary. Literature about minorities speaks a language (...) deliberately distant from the national one. Minority status has little to do with population numbers for Aamir Mufti; instead it signifies [End Page 61] tential victimization through disproportional rights, since “minority is always potentially exile” (Mufti 13). This definition of minority suits his two examples—Jews in Germany and Muslims in India—since in the twentieth century both fledgling nations adopted forms of nationalism that regarded the lives of these minorities as contaminants to the purity of the emergent national body. The prologue catalogues the brutality in India that prompted Mufti to write this book. Among the horrors listed were the destruction of Babri Mosque at Ayodhya in 1992 and the videotaped gang rapes of Muslim women that became a widespread form of entertainment in India. While Mufti reads violence toward minorities as correlative with the rise of nationstates, he considers similarities and differences between nation building in the West and in the subcontinent. In both cases, the new establishment of political equality for citizens came along with the desire to pare down the number of officially recognized citizens. Muslim and Jewish minorities migrated to “minority” nations in the collapsing British Empire, in present-day Pakistan and Israel, respectively, during the respective formations of India and Germany. By founding nations on formerly British-occupied territory, minorities potentially would enjoy the role of nationalist majorities. This solution strikes Mufti as spreading the nationalist contagion onto the minority.The whole book lets literature mark broad cultural attitudes and phenomena. The first chapter observes incipient Jewish nationalism in a work by a British author, Daniel Deronda by George Eliot, who spent time in Germany and grew fascinated with the Jewish question while abroad. Her Britishness reinforces a pattern in Mufti’s schema: British powers facilitate the rise of nationalism among minorities in India and in Germany. Daniel Deronda comes at the tail end of a long discourse on Jews’ relation to Europe. The first of Mufti’s cases within canonical literature is the hope for tolerance and a dialogue of cultures, which G. E. Lessing allegorizes through a drama about Saladin, the Muslim sultan of Egypt and Syria, who learns to trust the eponymous Jewish merchant in Nathan the Wise. “Muslim” stands in for “Christian” since Nathan’s alienation is allegorical for the alienation of Jews in Lutheran Germany. Heinrich Heine weighs in on the advantages to assimilation in this period with his fragmentary novel The Rabbi from Bacherach, where religiously raised Jewish children feel comforted when they hear the Tale of the Nibelungen from Father Rhein, the personification of a river that figures generally for German national myth and, in Heine’s story, as a possible source of comfort for partially assimilated minorities. If we read literature as a barometer of cultural pressures, then the appeal of assimilation for European Jews declines in the late colonial nineteenth century when George Eliot inscribed religion into the “secular” discourse of national citizenship.Since the Israeli state is outside of the range of his argument, we leave the Jewish Question with George Eliot’s philo-Semitism in Daniel Deronda, where the only hope for European Jews is to become a nation and to occupy the Palestinian territory. Mufti compares the concerns of early Zionism and Pakistani nationalism side by side in chapter 2. Pakistani issues dominate chapters 3 to 5. In chapter 2, he launches the comparison with the parallel between Hebrew’s development as a national language to identify [End Page 62] Jews secularly and culturally, not just religiously, and Urdu’s transition from a vernacular language to a national language with the secular goal of creating a Pakistani culture freed from Hindi’s erstwhile predominance. Commentators often claim that medical research subjects are coerced into participating in clinical studies. In recent years, such claims have appeared especially frequently in ethical discussions of research in developing countries. Medical research ethics is more important than ever as we move into the 21st century because worldwide the pharmaceutical industry has grown so much and shows no sign of slowing its growth. This means that more people are involved in medical research today than ever before, and in the future (...) even more will be involved. However, despite the pressing need for reflection on research ethics, it is important to carefully identify the concerns we have about research. Otherwise we run the risk that the moral language we use, and which we hear other people use, may do our moral thinking for us. We argue that many recent claims about the occurrence of coercion in medical research are misguided and misuse the word "coercion." We try to identify the real problems, and urge people to attend carefully to the implications of their descriptions of moral problems in research. (shrink)

Hans Blumenberg is celebrated for demonstrating that metaphors have had a more foundational influence than concepts on European intellectual history. Many acknowledge that his insights might have achieved even greater impact if he had articulated a more explicit theory of metaphor. In 1960 Blumenberg discusses the historical formation of metaphors that have given rise to meaningful discourses on metaphysical abstractions, like God, existence, or Being, but he does not develop a general model of metaphoric language, and his work rarely engages (...) with other contemporary theories of metaphor. During Blumenberg’s lifetime, French and German postwar philosophers rarely cited one another. Yet French hermeneutics, and the work of philosopher Paul Ricoeur in particular, may have strongly influenced Blumenberg’s research group, Poetik und Hermeneutik. This paper is an attempt to recuperate intellectual affinities between Blumenberg and Ricoeur, in order to demonstrate that Ricoeur’s claims about metaphor provide the theoretical background for a fuller appreciation of Blumenberg’s metaphor analyses. Hilde Lindemann argues that personhood is the shared practice of recognizing and responding to one another. She calls this practice holding. Holding, however, can fail. Holding failure, by stereotyping for example, can inhibit others’ epistemic confidence and ability to recall true beliefs as well as create an environment of racism or sexism. How might we avoid holding failure? Holding failure, I argue, has many epistemic dimensions, so I argue that moral encroachment has the theoretical tools available to avoid holding failures. (...) The goal of this paper, therefore, is to articulate and understand the epistemology of holding in an attempt to remedy holding failure. I show that the virtue of wokeness emerges from an epistemic environment tainted with moral encroachment. I argue that as long as an individual is woke, she will have a tendency to avoid holding failures. Wokeness and moral encroachment, consequently, are fundamental to the epistemology of holding and consistent proper holding. (shrink)

Much of the climate ethics discussion centers on considerations of compensatory justice and historical accountability. However, little attention is given to supporting and defending the Beneficiary Pays Principle as a guide for policymaking. This principle states that those who have benefitted from an instance of harm have an obligation to compensate those who have been harmed. Thus, this principle implies that those benefitted by industrialization and carbon emission owe compensation to those who have been harmed by climate change. Beneficiary Pays (...) is commonly juxtaposed with Polluter Pays Principle and the Ability to Pay Principle in the relevant literature. Beneficiary Pays withstands objections that raise suspicion for the latter two. (shrink)

This paper offers an alternate explanation of cases from the doxastic wronging literature. These cases violate what I call the degree of inquiry right—a novel account of zetetic obligations to inquire when interests are at stake. The degree of inquiry right is a moral right against other epistemic agents to inquire to a certain threshold when a belief undermines one’s interests. Thus, the agents are sometimes obligated to leave inquiry open. I argue that we have relevant interests in reputation, relationships, (...) and the well-being of our social groups. These interests generate obligations against others to “do their homework” before closing inquiry. This alternate account makes better sense of puzzles that accounts of doxastic wronging fall prey to. (shrink)

ABSTRACT Rima Basu and I have offered separate accounts of wokeness as an anti-racist ethical concept. Our accounts endorse controversial doctrines in epistemology: doxastic wronging, doxastic voluntarism, and moral encroachment. Many philosophers deny these three views, favoring instead some ordinary standards for epistemic justification. I call this denial the standard view. In this paper, I offer an account of wokeness that is consistent with the standard view. I argue that wokeness is best understood as ‘group epistemic partiality’. The woke person (...) does extra epistemic work before forming a negative belief about a member of an oppressed social group. Just as we do extra epistemic work when forming belief about our friends, so the woke person does for members of oppressed social groups. I first outline the account. I then raise questions about the scope of wokeness and belief formation. After this, I demonstrate that the group partiality view is consistent with the standard view in epistemology. The partiality view, therefore, should appeal to epistemologists who have adopted the standard view because it is consistent with ordinary standards of justification. I conclude that wokeness as a concept in epistemology should not be controversial for those who endorse the standard view. (shrink)
